This Civil Revision Petition is filed by the petitioners
aggrieved by the order dated 15.02.2024 passed in I.A.No.522
of 2023 in O.S.No.686 of 2023 on the file of II-Additional
Junior Civil Judge-cum-Special Judicial Magistrate of First
Class Prohibition and Excise, Mahabubnagar. The petitioners
herein are defendants 2 and 3 in the suit.
2. For the sake of convenience the petitioners herein are
referred to as defendants 2 and 3 and the respondents 1 and
2 are referred to as plaintiffs.
3. The defendants 2 and 3 claim that the plaintiffs filed a
malicious suit to illegally acquire the property, which the
defendants 2 and 3 purchased after paying consideration. The
defendants 2 and 3 deny the plaintiffs’ ownership and
possession over the suit property. The plaintiffs delivered
possession of the property first to the defendant No.1 during
the execution of the sale deeds, who in turn delivered the
property to defendants 2 and 3. The defendants 2 and 3 are
not concerned with the transactions and Memorandum of
Understanding (MOU) between the plaintiffs and defendant
No.1. The plaintiffs have no right to claim the property,
especially after becoming witnesses to the documents
executed by defendant No. 1 in favor of defendants 2 and 3. It
is further alleged that the plaintiffs issued notice to the
defendants 2 and 3, which were replied to and despite this
plaintiffs filed a suit and obtained a status quo order. The
defendants 2 and 3 claim that the suit is not maintainable,
and the Court lacks jurisdiction to entertain the suit.
