3. According to DAR filed in both the cases, on 10.03.2022,
injured Dr. Nimisha was sitting in E-Rickshaw which was being driven by
another injured Ashok Kumar. At about 6:00 pm, when the said rickshaw
reached at Jail Road, Sector – 18 Red Light, Rohini, Delhi, one Etios Car
bearing no. DL10-CG-4701 which was being driven by its driver at a very
high speed in a rash and negligent manner, came from behind and hit against
the aforesaid rickshaw with a great force, as a result of which, said rickshaw
got overturned and both the petitioners namely Dr. Nimisha and Ashok
Kumar sustained several injuries. They both were taken to Hospital where
they were medically examined. FIR No. 274/22 u/s. 279/337/338 IPC was
registered at PS. S.P. Badli with regard to the said accident. It is claimed that
offending vehicle was owned by respondent no. 2 and insured with Liberty
General Insurance Ltd./respondent no. 3 during the period in question.
