ORAL ORDER
The petition is filed under Section 528 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 (for short,
BNSS, 2023) praying to quash the FIR No.144 of 2025
registered by Avalahalli Police for the offences punishable
under Sections 318(2), 318(4), 69, 89 of BNSS, 2023.
2. The application under Section 359(2) of BNSS,
2023 is filed by the learned counsel for the petitioner. It is
enclosed with an affidavit of Shri.Anilkumar (father of the
petitioner herein).
3. Shri. Parameswaraiah, learned counsel files
Vakalath for Respondent No.2 and also files affidavit of
Respondent No.2.

4. Respondent No.2 is present before the Court
and submits that she has settled the matter with the
petitioner. She submits that at the intervention of parents
of the petitioner and for her better future, she has decided
not to prosecute the petitioner and she has no objection to
quash the FIR. The said terms are also stated in the
affidavit of Respondent No.2.
5. Respondent No.2 is aged 23 years and she
submits that she is a Graduate in Bachelor of Technology.
6. In a similar set of circumstances the
Co-ordinate Bench of this Court in the case of SRI
SATHISH.K. VS. STATE OF KARNATAKA in Crl.P.No.
4172 of 2022 recorded the settlement filed by way of
affidavit in crime registered for the offences punishable
under Sections 376, 504 and 506 of IPC and quashed the
FIR.
7. In view of the settlement between the
petitioner and Respondent No.2, FIR registered against the
petitioner in Crime No.144 of 2025 of Avalahally Police

Station, Bengaluru is quashed. Accordingly, petition is
dispose of.
