The instant complaint emanates from the complaint
made by complainant against the accused persons for the
offence punishable U/s.454(8)(i) & (ii) of the Companies Act,
2013 (hereinafter referred as to “the Act”).
2. The complainant’s case in nutshell is as under:
The accused No.1 is a Private Limited Company,
incorporated on 10.10.2011. The accused Nos.2 & 3 are the
Directors of the accused No.1 company at the relevant point
of time, they are claimed to be officers in default as
contemplated U/s.2(60) of the Act. Further, it is the case of
the complainant that, as per Section 12(3)(c) of the Act, every
company shall get its name, address of its registered office,
Corporate Identity Number along with telephone number, fax
number, e-mail and website addresses, if any, printed in all
its business letters, bill heads, in its notices and other official
publications.
