Petitioner/accused No.1 has field this petition under

section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023

read with section 439 of the Criminal Procedure Code, 1973,

for grant of regular bail as the petitioner/accused No.1 is in

Judicial Custody from the date of her arrest i.e., on

29.05.2024, in Crime No.43/2024 of Mahalingapur P.S.,

pending on the file of I Additional District and Sessions

Judge, Bagalkot, sitting at Jamkhandi, for the offence

punishable under sections 312, 313, 314, 315, 316, 304 of

Indian Penal Code, 1860 (‘IPC‘ for short).

2. Learned Additional Government Advocate has

filed statement of objections.

3. Heard arguments on both the sides.

4. It is submitted by the learned counsel appearing

for the petitioner that accused Nos.2, 3 and 6 are already

released on bail as per the order of this Court in

Crl.P.No.103294/2024 dated 22.11.2024 and accused No.4 is

also released on bail by this Court in Crl.P.No.102644/2024

dated 05.09.2024 and the present petitioner is a widow

having two minor children and from the date of arrest she is

in Judicial Custody. The petitioner/accused No.1 is not

required for further investigation. The accused is ready to

abide by the conditions to be imposed by this Court; the

charge sheet is already filed. Hence, sought for allowing this

petition.

5. A perusal of the charge sheet, the Investigating

Officer submitted charge sheet against the accused for the

offence punishable under sections 312, 313, 314, 315, 316,

304 of IPC. The substance of accusation made in the charge

6. The petitioner/accused No.1 is in custody from

the date of her arrest i.e., on 29.05.2024; she is not

required for further investigation. This Court has already

assigned reasons while releasing the remaining accused

Nos.2, 3, 4 and 6. The alleged offences are not punishable

with death. The apprehension of the prosecution is that if the

petitioner/accused No.1 is released on bail, she may threaten

or tamper with the prosecution witnesses and also she may

abscond, may be overcome by imposing conditions. Hence,

I proceed to pass the following:

ORDER

i) The Criminal Petition filed by the

petitioner/accused No.1 under section 483

of Bharatiya Nagarik Suraksha Sanhita,

2023, read with section 439 of the Criminal

Procedure Code, 1973, is hereby allowed.

ii) The petitioner/accused No.1 shall be

released on bail on executing a personal

bond for a sum of Rs.50,000/- (Fifty

Thousand Rupees Only) along with two

sureties for the like sum to the satisfaction

of the trial Court.

iii) The petitioner/accused No.1 shall furnish

her residential address proof and shall

inform the Investigating Officer/Court, if

there is any change in the address.

iv) The petitioner/accused No.1 shall not

threaten or tamper with the prosecution

witnesses either directly or indirectly.

v) The petitioner/accused No.1 shall not

indulge in any criminal activities.

vi) The petitioner/accused No.1 shall be regular

in attending the Court proceedings.
