1. By this petition, the petitioner has alleged non-compliance and willful
disobedience of order dated 22.12.2023 passed in CRM(M)
No.1078/2023 titled Vinod Kumar v. UT of J&K and others, whereby
the Investigating Officer was directed to investigate the matter.
However, it was provided that the challan shall not be presented without
seeking prior permission of this Court. It is stated by the learned counsel
for the petitioner that the Investigating Officer had filed the final closure
report before the learned Sub Judge, Jammu without seeking prior
permission of this Court.
2. Learned counsel for the petitioner states that the proceedings in
CRM(M) No.1078/2023, which was filed by one Vinod Kumar
challenging the FIR No.174/2022 registered on the complaint of the
petitioner, already stand closed vide order dated 24.05.2024.
3. Compliance report stands filed, wherein it is stated that inadvertently the
closure report of the case was presented before the Court, however, the
same stands withdrawn.

4. In view of the compliance report, learned counsel for the petitioner
states that the petitioner does not want to press the instant petition.
Accordingly, proceedings in this petition are closed. However, the
Investigating Officer shall proceed with the investigation and produce
the final report.
