After hearing learned counsel for the parties, we are of the prima facie view

that the petition, seeking a direction to the Tribunal to make a reference of

questions of law ought to have been filed under Section 75 of the J&K Value

Added Tax (VAT) Act, 2005. However, the petitioners have filed it purportedly

under Section 12-D of the J&K GST Act, 1962 read with Section 6 of the J&K

Entry Tax on Goods Act, 2000.

From plain reading of questions proposed by the petitioners, it clearly

transpires that the questions prima facie arise out of the proceedings under the

J&K, VAT Act, 2005.

Faced with the aforesaid position, Mr. Mohsin Qadri, learned Sr. AAG,

appearing for the petitioners prays for and is granted short adjournment to seek

instructions in the matter and do the needful, as may be permissible.
