After hearing learned counsel for the parties, we are of the prima facie viewthat the petition, seeking a direction to the Tribunal to make a reference of
questions of law ought to have been filed under Section 75 of the J&K Value
Added Tax (VAT) Act, 2005. However, the petitioners have filed it purportedly
under Section 12-D of the J&K GST Act, 1962 read with Section 6 of the J&K
Entry Tax on Goods Act, 2000.
From plain reading of questions proposed by the petitioners, it clearly
transpires that the questions prima facie arise out of the proceedings under the
