1. This criminal revision petition under Section 397 read with

401 of the Cr.P.C. and Section 11 of the Probation of Offenders Act

has been preferred by the petitioner against the judgment dated

17.08.2007, passed by the learned Sessions Judge, Pali in

Criminal Appeal No.26/2007, whereby the learned Sessions Judge

has partly upheld the judgment dated 29.03.2007, passed by the

learned Chief Judicial Magistrate, Pali (“hereinafter referred to as

the Trial Court”) in Original Criminal Case No.112/2006, upto the

extent of offence under Section 504 IPC and acquitted the

accused-petitioner for the offence under Section 353 IPC. The

learned trial Court has given the benefit of Probation of Offenders

Act and released the petitioner-convict on probation for one year

under while giving benefit of Section 4 of the Probation of

Offenders Act, 1958.
