The Investigating Officer, Sri Abdul Ahad, the Deputy
Superintendent of Police, Koppa Sub-Division, Koppa, has submitted
a charge-sheet against accused Nos. 2, 4, 7, and other accused
persons for offences punishable under Sections 143, 144, 147, 148,
and 506 read with Section 149 of the Indian Penal Code 1860
(‘IPC’), Sections 3 and 25 of the Indian Arms Act, 1959 (‘Arms Act’),
and Sections 13 and 18 of the Unlawful Activities (Prevention) Act,
1967 (‘U.A.(P) Act’).

2. The brief facts of the prosecution case are as follows:

(a) PW.9, Sri Sadananda Thippannavar, received information
from public that on 05.03.2009, at around 8:00 p.m., two men and
two women Naxalites gathered 80-100 persons near the shop of Sri
Umesh in Bukkadibailu and held a meeting. In the meeting, the
Naxalites gave speeches that they fought for the welfare of the
public against the government and some of their associates
sacrificed their lives for the welfare of the public, and also solicited
the support of the audience to their activities. The naxalites were
armed with guns. They left naxal related pamphlets at the spot and
left the place shouting naxal slogans. The meeting was held under
the leadership of accused No. 1, B.G. Krishnamurthy, and accused
No.2, Mundagaru Latha. However, no one came forward to lodge a
complaint against the Naxalites. Therefore, PW.9 prepared a report
and sent it to CW.11, Smt. Renukamma, the SHO of the Sringeri
police station through CW.10, Sri A.B. Manjaiah. Based on this
information, CW.11 registered a case in Crime No. 17/2009 for
offences punishable under Sections 143, 144, 147, 148 read with

Section 149 of the IPC, Sections 3 and 25 of the Arms Act, and
Sections 13 and 18 of the U.A.(P) Act, and handed over the
investigation to PW.9.
