Heard Mr. Ajay Kumar Thakur, learned counsel for the
petitioner, learned A.P.P. for the State and learned counsel for
the informant.
2. The petitioner seeks bail in connection with
Triveniganj P.S. Case No. 577 of 2022 registered for the
offences punishable u/s 148, 149, 448, 341, 323, 326, 307, 302
and 427 of the Indian Penal Code and Section 27 of the Arms
Act.
3. The First Information Report discloses an allegation
against nine accused persons that they came variously armed to
the house of the informant and gave knife blows to the father of
the informant, namely, Rajendra Rai who was declared dead in
course of his treatment. There is further allegation that others

were also assaulted by various arms.
4. It has subsequently come during the course of
investigation that the allegations on the petitioner is that of
giving a gun shot injury upon Mithun Rai and the injury report
of the said injured Mithun Rai is available in the case diary
which would go to show that he has received a gun shot injury
on the left side of the chest and while initially the opinion on
injury was reserved, the final injury report would show that the
said injury is a bullet injury which is grievous in nature.
5. Learned counsel for the petitioner, however, submits
that there is case and counter case and the persons on the side of
the petitioner have also received injuries. It is next submitted
that the petitioner has been languishing in custody since
13.01.2025 and the charge sheet has also been submitted against
him.
6. Learned APP for the State and learned counsel for the
informant oppose the prayer for bail on the ground that there is
an allegation on the petitioner of giving gun shot injury to one
Mithun Rai and he has received a grievous injury on vital part
of his body, i.e., chest.
7. Considering the nature of the allegation and also the
grievous injury sustained by injured Mithun Rai, I am not

inclined to grant bail to the petitioner named above. The prayer
for bail is hereby rejected.
8. Accordingly, the bail application is dismissed.
9. However, the petitioner is at liberty to renew his prayer
for bail after framing of charge against him.
