O R D E R
1. The parties were referred to the Supreme Court Mediation
Centre for the purpose of exploring possibility of amicable
settlement. We are happy to note that the parties have been able
to resolve all their disputes before the Supreme Court Mediation
Centre.
2. The terms of the settlement have been reduced into writing,
duly signed by the parties including the learned Mediator and the
learned counsel appearing for the respective parties.
3. The original Settlement agreement is ordered to be taken on
record.
4. The Settlement Agreement reads thus:-
“This Settlement Agreement is being executed between Petitioner/
Ms. Isha Agarwal W/o Mr. Anuj Agarwal D/o Mr. Pramod Agarwal R/o
Gaira Bari Bazar, near State Bank of India, Korha, Katihar-
854108 (Bihar).

The Grand Residence, Kanak Vrindavan, Sirsa Road, Jaipur–
302012. Through his Special Power of Attorney Sh. Pramod Agarwal
duly authorized by way of a Special Power of Attorney dated
6.12.2022, who shall sign and execute this Settlement Agreement
on behalf of the Respondent, Mr. Anuj Agarwal. The Special Power
of Attorney dated 6.12.2022 is attached with the present
Agreement as Annexure A.The marriage between the Petitioner and Respondent was
registered before the Marriage Registration Officer Jaipur on
15.10.2020 and solemnised as per Hindu rites and customs on
25.11 .2020 at Jaipur, Rajasthan. Both parties resided together
as husband and wife at Amsterdam till 24.10.2021. That
thereafter, due to some differences between the parties, they
started living separately. There is no issue from this wedlock.
This Hon’ble Court vide its order dated 04.02.2025 was pleased
to refer the matter to Mediation Centre, Supreme Court of India,
New Delhi.
Comprehensive mediation sessions were held with the parties
separately and jointly on 28.02.2025, 25.04.2025 and today i.e.
on 03.05.2025 and with the indulgence of counsels and Ld.
Mediator, the parties have arrived at an amicable settlement on
the following terms and conditions:
1. Both the parties hereto conform and declare that they have
voluntarily and of their own free-will, decided not to live
together as husband and wife and have arrived at this Settlement
in the presence of the mediator and their respective counsels.
2 That the following cases are pending between the parties
shall be withdrawn by both the parties: –
I. Divorce Petition bearing H.M.A No. 601 of 2023 under
Section 13(1 )(ia) of Hindu Marriage Act, 1955 titled
“Anuj Agarwal Versus Smt. Isha Agarwal” pending before
the Court of the Ld. Additional Principal Judge, Family
Court, Gurugram titled as ” Anuj Agarwal Versus Smt.
Isha Agarwal” and all the proceedings arising therefrom.
II. CIS No. CHl/2901/2023 titled as “State of Haryana vs.
Anuj Agarwal‘ pending before the Judicial Magistrate
First Class, Gurugram arising out of Fl R No.195/2022
dated 02.11.2022;

III Transfer Petition (C) No. 67 of 2024 titled “Isha
Agarwal vs Anuj Agarwal‘ pending before the Hon’ble
Supreme Court of India.
IV. Any other pending cases/complaints (Civil or
Criminal) against either parties and their family
members or friends, if any.
3. That both the parties have entered into a full and final
settlement / agreement in respect to the above-mentioned
cases on the following terms & conditions.
(a) It has been agreed between both the parties that
Respondent/ husband shall pay a sum of Rs. 40,00,000/-
(Rupees Forty Lakhs Only) as all-inclusive alimony
towards her Stridhan, maintenance, past, present, future
and permanent alimony and any other claims whether
criminal or civil in nature, as a one-time full and
final settlement to Petitioner/wife Ms. Isha Agarwal by
way of a Demand Draft bearing No. 977983 dated
02.05.2025 payable at Mumbai in the name of ‘Isha
Agarwal’ at the time of next date of listing / hearing
before this Hon’ble Court.
(b) It is been further agreed upon between the parties
that the Respondent Husband shall pay Rs.1,00,000/-
(Rupees One Lakh Only) towards litigation expenses by way
of a Demand Draft bearing No. 977984 dated 02.05.2025
payable at Mumbai in the name of ‘Isha Agarwal’ at the
time of next date of listing /hearing before this Hon’ble
Court.
(b) That both the parties herein agree that they shall
jointly file an application within one month of signing of
the present Settlement Agreement with a prayer to the
Hon’ble Supreme Court to exercise its power under Article
142 of the Constitution of India and to grant Decree of
Divorce by mutual consent, quashing and withdrawal of all
Criminal and Civil cases pending between the parties and
their relatives.
4. That both the parties herein agree that all the pending cases
whether specifically mentioned at Paragraph no. 2 above, or not
between the parties & their family members arising out of the
present matrimonial dispute herein shall be withdrawn. The
parties and I or their family members, relatives or
representatives undertake not to initiate any other litigation

against each other in future also.
5. That both the parties undertake that neither of the party
retains any valuable item, records, certificates, documents or
belongings of the other.
6. That both the parties undertake that all pending litigations
filed against each other shall be withdrawn by both the parties
upon execution of this settlement agreement.
7. That both the parties have agreed that none of them will make
any effort to defame / malign the other party in person or their
respective parents or relatives through any media, social media
or any forum in any other manner whatsoever.
8. Both the parties agree and undertake that they have settled
all their disputes and grievances against each other and against
their family members amicably and they shall not file any
complaints, proceedings whether criminal or civil, if any
against each other or their family members or stake any claim on
the movable or immovable, joint or ancestral, self-acquired or
HUF properties of either parties and their respective families.
Both the parties further undertake to withdraw the aforesaid
matters or any other matter if any pending against each other
anywhere in any other Court of Law in India.
9. By signing this Agreement, the parties hereto solemnly state
and affirm that they have no further claims or demands in any
manner whatsoever against each other and all the disputes and
differences have been amicably settled by the parties hereto,
through the process of Mediation.
10. That both the parties agree and undertake that they have
settled all their disputes and grievances against each other and
against their respective family members amicably in terms of the
present settlement agreement and have further agreed to remain
bound by the terms and conditions as have been mutually and
amicably agreed by the parties herein.
The parties undertake to abide by the terms and conditions set
out in the above-mentioned Agreement, which have been arrived
without any coercion, duress or collusion and undertake not to
raise any dispute whatsoever henceforth.”
5. The Parties are directed to abide by the terms and conditions
of the settlement.
6. All proceedings between the parties civil as well as criminal

stand terminated.
7. In view of the afore-said, we dissolve the marriage between
the parties in exercise of our powers under Article 142 of the
Constitution.
8. Registry to draw a decree of divorce accordingly.
9. The petition stands disposed of accordingly.
10. Pending application(s), if any, stands disposed of.
