The present claim petition has been filed by the

petitioners against the respondents under Section 166 of

Motor Vehicles Act, seeking compensation of Rs.50,00,000/-

with interest for the death of Smt. M. R. Sangeetha in a

Road Traffic Accident that occurred on 16-06-2024.

2. The case of the petitioners in brief is as under:

That, on 16.06.2024 at about 4.00 to 4.05 p.m., deceased

M.R. Sangeetha was proceeding in the Motor cycle bearing

Reg. No.KA-16-ER-5877 as a pillion rider and the same was

ridden by her husband and while they were proceeding from

Challekere to Hiriyur, near Gollahalli village, at that time,

the driver of Ashok Leyland goods carrier bearing Reg.

No.AP-02-TC-7819 came from opposite direction at high

speed, in a rash and negligent manner and dashed against

the said motor cycle and caused the accident. Due to the

impact, the said M.R. Sangeetha who was proceeding in the

said motor cycle fell down and sustained fatal injuries and

died at the spot. Petitioner No.1 is the husband and

petitioner No.2 is minor daughter and they are the legal

heirs of deceased. Prior to the accident, the deceased was

hale and healthy, she was working as a Tailor and was

earning Rs.25,000/- to 30,000/- per month. Due to death of

deceased, the petitioners have lost their source of income and

are put to mental shock and agony. Further, the accident was

occurred due to the rash and negligent driving of the driver

of the Ashok Leyland Goods carrier bearing Reg. No.AP-02-

TC-7819. As such, the respondent No.1 being insurer and

respondent No.2 being owner are jointly and severally liable

to pay compensation to the petitioners. Hence, the

petitioners prayed to award compensation of Rs.50,00,000/-

from the respondents under all heads together with interest

and costs.
