Heard Learned Counsel for the petitioners and

Learned APP for the State.

2. The petitioners seek regular bail in a case registered

for the offences punishable in connection with Beerpur P.S.

Case No.75 of 2018, S.T. No.177 of 2020 under Sections 341,

323, 324, 307 and 504/34 of the Indian Penal Code.

3. Learned Counsel for the petitioners submits that the

anticipatory bail has been granted to the petitioners on

furnishing bail bond, but counsel of the petitioners has not

intimated to them that they have to appear before the court day

to day basis and only due to this reason, their bail bond have

been cancelled.

4. Counsel for the petitioners further submits that due

to non-communication of their counsel, process of sections 82

and 83 of the I.P.C. were issued, in result, petitioners were

arrested on 22.03.2025 and presently they were in judicial

custody.

5. Counsel also submits that petitioners are in custody

since 22.03.2025 having clean antecedent. He further submits

that petitioners are ready to appear before the court on day to

day basis.

6. Learned APP for the State opposes the prayer for

bail and anticipatory bail was granted to the petitioners with

direction to appear in person, but they have not appeared, in

result, bail bond has been cancelled. Today, the stage of this case

is that charge has not been framed till date and this case is

pending since 2018.

7. In the present facts and circumstances of this case

and the submissions made above, let the petitioners above

named, be granted bail, but only after framing of charge

imposing condition that they shall not evade their

appearance during trial, on furnishing bail bonds of

Rs.30,000/- (Rupees Thirty thousand) each as mentioned in

Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Addl.

Sessions Judge-Vth, Begusarai in connection with Beerpur P.S.

Case No.75 of 2018, S.T. No.177 of 2020 subject to the

following conditions as laid down under Section 480(3) of the

Bharatiya Nagarik Suraksha Sanhita, 2023.
