This application has been filed by the

applicant/respondent for release of amount of compensation

to him in terms of order dated 12.01.1999, passed by the

Workman Compensation Commissioner (SDM), Solan, District

Solan (H.P), in Case No.15/WC of 1997, whereby non-

applicant/petitioner was directed to deposit compensation

amount amounting to Rs.60,000/- alongwith interest @12%

per annum from 28.03.1997 till its realization and to credit

penalty of Rs.30,000/- to the State Government.

Petitioner is entitled for release of amount of

compensation amounting to Rs.60,000/- alongwith up to date

interest.

At this stage, Mr. Rahul Gathania, Advocate,

representing the legal heir of deceased applicant/petitioner,

under instructions, received from Saurav Sharma, S/o Late

K.C. Sharma (deceased-petitioner) has communicated no

objection for releasing the amount of compensation deposited

by petitioner in the Registry of this Court, alongwith up to

date interest, in favour of the applicant.
In view of above, amount deposited by or on behalf

of the petitioner in terms of order dated 12.01.1999, in Case

No.15/WC of 1997, titled as Mohammad Latif Vs. Shri. K.C.

Sharma is directed to be released in favour of the

applicant/respondent, as per his entitlement in terms of

aforesaid order by remitting the same alongwith up to date

interest, in the bank account of the applicant/respondent as

mentioned in Para No.3 of the application. Copy of front page

of saving bank account (Annexure P-6) has been placed on

record with the application.

State is also at liberty to take appropriate step for

transfer of Rs.30,000/-, penalty alongwith interest, if any

accrued thereon.

Records be sent back.

The present application stands disposed of, in

aforesaid terms.
