The Court:
1. This is an application for appointment of an Arbitrator under the
provisions of Section 11 of the Arbitration and Conciliation Act, 1996
(hereinafter referred to as the said agreement). Disputes and differences
allegedly cropped up between the petitioners and the respondents out of
the agreement for sale dated August 14, 2017. According to the
petitioners, who were described as tenant / purchasers in the said
agreement, the respondents were required to hand over possession of
three shop rooms in adjacent premises situated at 290A Gopal Lal
Tagore Road, P.S. Baranagar, Kolkata 700036.
2. The petitioners allege that the shop rooms were handed over belatedly
and in incomplete condition. The petitioners contend that the
agreement provides for compensation for each day’s delay. Moreover,
the allegation is that, the respondents had committed breach in not
handing over the shop rooms as per the agreement between the parties.
