1. Sri Sunil Kumar Verma, Advocate, holding brief of Sri Alok Kumar Gupta, Advocate, filed vaklatnama on behalf of the Opposite Party No.2 is taken on record.
2. The present application under Section 528 of the BNSS, 2023 has been filed to quash the entire proceedings of Case No. 831 of 2025 (State v. Ramjeevan Pal and Others), arising out of Case Crime No. 249 of 2024, under Sections 498A, 323, 504 and 506 of IPC and Section 3/4 D.P. Act, Police Station- Rath, District Hamirpur, as well as cognizance/summoning order dated 3.4.2025, pending in the Court of Additional Chief Judicial Magistrate, Rath, Hamirpur on the basis of compromise dated 24.3.2025.
3. Learned counsel for both the parties submitted that the parties have settled their matrimonial dispute with regard to the offences punishable under Sections 498A, 323, 504 and 506 of IPC and Section 3/4 D.P. Act by way of compromise and both the parties are living as husband and wife peacefully after compromise. Learned counsel for both the parties further submits that both the parties settled their disputes by own wishes without no coercion and the certified copy of compromise is on record as Annexure No.3 to the affidavit.
