This is a private complaint filed by the complainant

against the accused no.1 & 2 for the offence punishable

under Section 138 of Negotiable Instruments Act.

2. The brief facts of the complainant’s case is as

under:

It is contended that, the complainant and the accused

no.1 are the friends from past 5 years. The accused no.2 is

the wife of the accused no.1. The accused no.1 & 2 have

borrowed hand loan of Rs.12 lakhs on 20.03.2018 for their

family and business necessity and have executed the loan

agreement. They have agreed to return back Rs.9 lakhs on

18.09.2018 and Rs.3 lakhs on 09.10.2018 and also issued

two cheques bearing No.000005, dt: 18.09.2018 for Rs. 9

lakhs and 000004, dt:09.10.2018 for Rs.3 lakhs, both drawn

on Lakshmi Villas Bank, Basaveshwaranagar Branch,

C.C.No. 30531/2018

Bengaluru, to the complainant assuring to return back the

amount and in failing to return the amount, the

complainant can claim 18% interest p.a on the loan amount.
