This case is registered against the accused for the

offence punishable U/s 138 of Negotiable Instruments

Act.

2. Factual matrix of the complainant’s case is as

under:

It is stated that the complainant is engaged into

vegetable farming. He has cultivated colour capsicum in 2

acres of land. The accused has approached the

complainant representing that she is wholesale buyer and

agent of farm products and requested to lease the entire

capsicum procurement as and when it is ready for

harvesting and entered into a crop harvesting agreement

dated 01.01.2022. As per the said agreement the crop

price was fixed at Rs.100/kg for A grade capsicum and

Rs.50/kg fixed for B grade capsicum, till the last day of

harvest. Initially the accused has made prompt payments

and eventually started delaying in payments. Even though

market rate of the capsicum was escalated upto 400%, the

complainant has abide by the terms and conditions for

price shown in the agreement.
