This case is registered against the accused for the

offence punishable U/s 138 of Negotiable Instruments

Act.

2. Factual matrix of the complainant’s case is as

under:

The complainant and his family members were on

lease term in the house No.19 of Vivekananda Road,

Vinayaka Nagar, Bangalore. They vacated the said

premises and found To-Let board for the house of the

accused. The complainant contacted the accused and saw

the premises. The wife of the complainant liked it and the

accused told that lease amount is Rs.12,50,000/-. The

complainant paid Rs.5,00,000/- by way of cash as advance,

as the the accused assured to handover house keys on

24.11.2020. Subsequently, the accused asked for

additional Rs.2,00,000/- as the existing family in the

property is asking. Accordingly, the complainant gave

Rs.2,00,000/- to the accused. The complainant was waiting

for the vacant portion of the lease premises, but it went in

vain and found that the property was mortgaged and the

accused has committed default in making loan payment.
