01. 1. This matter is taken up through Hybrid
Arrangement (Virtual/Physical Mode).
2. This is an application U/S.482 of BNSS by the
petitioner for grant of anticipatory bail to him in
connection with GR Case No.157 of 2023 arising out of
Barpali PS Case No.162 of 2023 pending in the file of
learned Judicial Magistrate (First Class), Barpali, for
commission of offences punishable U/S.379 of IPC and
Sections 25/27 of Arms Act, on the allegation of
committing theft of 3.8m dia MS pipe worth
Rs.1,10,000/-.
3. Heard, Mr. Ipsit Aurobindo Acharya, learned
counsel for the petitioner and Ms. S. Nayak, learned
Additional Public Prosecutor in the present matter and
perused the record.
4. After having considered the rival submissions
and ongoing through the materials placed on record,
more particularly absence of name of the petitioner in
Page 1 of 2
the FIR and taking into account the law laid down by the
Apex Court in Satendra Kumar Antil Vrs. Central
Bureau of Investigation; (2021) 10 SCC 773, it is
directed that in the event of his arrest, the petitioner
shall be released on pre-arrest bail by the Arresting
Officer on such terms and conditions as deems fit and
proper by him including the following conditions:-
(i) the petitioner shall make himself
available for interrogation by the IO as
and when required,
(ii) the petitioner shall not directly or
indirectly make any inducement, threat or
promise to any person acquainted with
the facts of the case so as to dissuade him
from disclosing such facts to the Court or
to any police officer.
5. Accordingly, the ABLAPL stands disposed of.
6. Issue urgent certified copy of the order as per
Rules.
