3. Mr. Tejas Agarwal, learned counsel for the
Applicant, makes a statement that when the
applicant was four months pregnant, her husband–
Suraj Maindola (respondent no. 2 herein)–assaulted
her. Following that incident, the parties have been
living separately, and several cases are pending
between them. He further states that after the said
incident, the Applicant lodged a complaint against
the Respondent no. 2. In retaliation, the Respondent
no. 2 also filed a complaint against the Applicant as
a counter-blast, which led to the institution of a
criminal case against her. The learned Magistrate
took cognizance of the said complaint, and after
investigation, a charge-sheet was filed against the
Applicant. The learned counsel for the Applicant has
approached this Court challenging the summoning
order and the charge-sheet filed against her.
