Plaintiff has filed this suit against the

defendants seeking the relief of declaration of his

caste as Bhavasara Kshatriya instead of Hindu

Marathi in his all school records.

2. It is averred in the plaint that, plaintiff is born

to late K.N.Narayana Rao and Smt.Jayalakshmi Bai

on 06.04.1964 and he is named as K.N.Gangadhar at

the time of naming ceremony and said name has

been continued in school records of the plaintiff. The

parents, friends, relatives and family members of

plaintiff are and were calling him by name

K.N.Gangadhar since from the day of his naming

ceremony. He has studied in the school of defendant

No.3 at Malleswaram Bangalore from 4 th standard to

7th standard, but actually he is belonged to

Bhavasara Kshatriya, but by oversight, his caste is

wrongly mentioned Hindu Marathi in the school

records. His sister by name Smt. Hemavathi K.N

studied in Government Pre-University College for

Girls at Malleswaram Bangalore and in her school

records, her caste is correctly mentioned as

Bhavasara Kshatriya. Even in the transfer certificate

of his son, caste of his son is correctly mentioned as

Bhavasara Kshatriya in the school records. He has

issued legal notice to the defendants under section

80 of CPC requesting to the defendants correct his

caste as Bhavasara Kshatriya instead of Hindu

Marathi in his school records. Even after receiving

the legal notice, defendants have not chosen to reply

to the Legal Notice issued by the plaintiff for which

he is constrained to filed this suit against the

defendants seeking the relief of declaration.
