2. This anticipatory bail application under Section 482 of
the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been
preferred by the petitioner apprehending his arrest in connection
with Borio P.S. Case No.61 of 2021, for offences under Sections
147, 148, 149, 323, 325, 341, 353, 307, 332, 333, 411 427, 379,
224, 225 and 120-B IPC. The case is presently pending before the
Court of learned Chief Judicial Magistrate, Sahibganj.
3. Learned A.P.P. representing the State opposes the
prayer for anticipatory bail.
4. It is alleged that one Surya Hansda, who is having some
criminal cases, has been taken in custody by the police but several
persons had forcibly taken Surya Hansda from custody of the
police.
5. From the record, it is clear that the petitioner is one of
them, though he has not been named in the F.I.R.
6. This case needs extensive investigation and also if
necessary, to put the petitioner on Test Identification Parade (TIP).
7. Considering the nature of allegation against this
petitioner, this is not a fit case for grant of anticipatory bail.
8. Accordingly, this Anticipatory Bail Application stands
dismissed.
