2. Mr. Akshay Latwal, learned A.G.A. for the State of
Uttarakhand.
3. The present application under Section 528 of the Bharatiya
Nagarik Suraksha Sanhita, 2023 has been filed for quashing the
charge-sheet dated 13.11.2024, summoning/cognizance order
dated 07.01.2025 and the entire proceedings of Criminal Case No.
12 of 2025, “State vs. Kulvinder Singh and Others” for the offence
punishable under Sections 323, 354, 498A, 504and 506 IPC and
under Section 3/4 of Dowry Prohibition Act, 1961, pending in the
Court of Civil Judge/Judicial Magistrate, Bazpur, District Udham
Singh Nagar.
3. The present matter relates to the matrimonial discord
between the parties.
4. Admit.
5. In view of the matter, this Court is of the opinion that the
presence of the Respondent No. 3 is required.
6. Issue notice to the Respondent No. 3.
7. Steps to be taken within a week.
8. List this case on 25.07.2025.
9. Counter affidavit, if any, may be filed in the meanwhile.
10. Till the next date of listing, the entire proceedings of
Criminal Case No. 12 of 2025, “State vs. Kulvinder Singh and
Others” for the offence punishable under Sections 323, 354,
498A, 504 and 506 IPC and under Section 3/4 of Dowry
Prohibition Act, 1961, pending in the Court of Civil Judge/Judicial
Magistrate, Bazpur, District Udham Singh Nagar, shall remain
stayed.
11. Stay Application (IA No. 01 of 2025) is disposed of
accordingly.
