The present bail applications have been preferred by the
petitioners under Section 483 of BNSS (Old Section 439 Cr.P.C.) in
connection with FIR No.88/05 dated 30.05.2025 registered at
Police Station Regional Forest Officer Chouhtan, District Barmer
for the offences punishable under Sections 9, 39, 48A, 49 & 51 of
Wild Life Protection Act.
2. Learned counsel for the petitioners submits that the
petitioners have falsely been implicated in this case. It is further

submitted that the offences are triable by Magistrate and there are
no other criminal antecedents against the present petitioners
apart from the one involved in the present case. Further, counsel
submits that no recovery is made out from the conscious
possession of the present petitioners. The accused-petitioners are
in judicial custody since long. Therefore, it is prayed that the
accused-petitioners may be enlarged on bail.
3. Learned Additional Advocate General has vehemently
opposed the bail application.
4. Having regard to the totality of the facts and circumstances
of the case, without expressing any opinion on the merits of the
case, I deem it just and proper to grant bail to the accused
petitioners under Section 483 of BNSS (Old Section 439 Cr.P.C.)
5. Accordingly, the bail applications filed under Section 483 of
BNSS (Old Section 439 Cr.P.C.) are allowed and it is directed that
petitioners (1) Prabhakar S/o Sh. Shanti Ram & (2) Sawai Lal S/o
Hazari Ram shall be released on bail in connection with FIR
No.88/05 dated 30.05.2025 registered at Police Station Regional
Forest Officer Chouhtan, District Barmer provided each of them
executes a personal bond in a sum of Rs.50,000/- with two sound
and solvent sureties of Rs.25,000/- each to the satisfaction of
learned trial Court for their appearance before that Court on each
and every date of hearing and whenever called upon to do so till
the completion of the trial.
