3. The present application under Section 528 of the Bharatiya
Nagarik Suraksha Sanhita, 2023, has been filed by the Applicant,
Vikas Kumar, S/o Udia Veer, against Respondent No. 2 for
quashing the charge sheet dated 11.01.2024, the cognizance
order dated 12.01.2024, and the entire proceedings in Criminal
Case No. 376/2024, titled as “State vs. Sachin Sharma and
Another” pertaining to offence punishable under Sections 420,
467, 468, 471, 483, 486, 274, 275, 336, and 120B of the Indian
Penal Code, 1860, pending before the Court of the ACJM/VIth
Additional Civil Judge (S.D.), Dehradun.
4. The parentage of Respondent No. 2 is not mentioned in the
Criminal Miscellaneous Application.
5. Admit.
6. Issue notice to Respondent No. 2.
7. Steps to be taken within one week.
8. Counter affidavit, if any, may be filed in the meantime.
9. List this case on 31.07.2025.
10. As an interim measure, it is directed that till the next date
of listing, the entire proceedings in Criminal Case No. 376/2024,
titled as “State vs. Sachin Sharma and Another“, for offence
punishable under Sections 420, 467, 468, 471, 483, 486, 274,
275, 336, and 120B of the Indian Penal Code, 1860, pending
before the Court of the ACJM/VIth Additional Civil Judge (S.D.),
Dehradun, shall remain stayed.
11. Interim Relief Application (I.A. No. 01 of 2025) stands
disposed of accordingly.
