                                                                   ORDER

This is first application filed by the applicant under Section 439 of the
Code of Criminal Procedure for grant of regular bail relating to FIR/Crime
No.176/2024 registered at Police Station Crime Branch, District Bhopal
(M.P.) for the offence punishable under Sections 419, 420, 467 and 471 of
IPC and Section 66(c)(d) of I.T. Act.

2. The allegation against the applicant is that applicant is charged for
defrauding the complainants Kunal and Akash Gaur to the tune of

Rs.3,19,999/-.

3. It is submitted by learned counsel for the applicant that the applicant
is aged about 29 years and is in custody since 09.11.2024. Hence, prayer is
made to enlarge the applicant on bail.

4. Per contra, learned counsel for the respondent/State opposed the
aforesaid prayer.

5. Learned counsel for the objector submits that applicant and
complainant have compromised the matter. He further submits that his party
has received back the payment to the tune of Rs.3,00,000/-, which was
obtained by fraud by the applicant. It is submitted by counsel for the
applicant that the applicant is ready to deposit balance amount of Rs.19,999/-
. Therefore, there is no objection if the bail is granted.

6. Heard learned counsel for the parties and perused the case diary.

7. Looking to the facts and circumstances of the case, without
expressing any view on the merits of the case, the application is allowed.

8. It is directed that the applicant shall be released on bail on paying
Rs.19,999/- to the complainant and furnishing a personal bond for a sum of
Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like

amount to the satisfaction of the trial Court concerned for his appearance
before the said Court on all such dates as may be fixed in this regard during
the pendency of trial.

9. It is further directed that the applicant shall comply with the
provisions of Section 437(3) of the Cr.P.C.

10. Accordingly, M.Cr.C. stands disposed of.
