In a trademark infringement suit filed by Wipro Enterprises against Wipro Gas Services, the Delhi High Court while recognizing that “WIPRO” is a well-known trade mark, restrained Wipro Gas Services from using the trademark “WIPRO” for gas pipeline, installation, and repair services.
The court has considered that Wipro has been using the trademark “WIPRO” for a long and has acquired immense goodwill and reputation.
While granting the injunction, the Court also considered that Wipro Enterprises and its group companies have the sole and exclusive rights in and over the trademark “WIPRO” and use of the same by any third party for any goods and services will amount to a violation of the rights vested in the trade mark “WIPRO”.
