The present bail application has been preferred by the

petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.) in

connection with FIR No.76/2025 registered at Police Station

Kotwali District Banswara for the offence punishable under Section

376 IPC.

2. Learned counsel for the petitioner submits that the petitioner

has falsely been implicated in this case. It is further submitted

that both the parties have amicably settled the disputes and now

they are living together. Learned counsel for the petitioner has

placed on record affidavit of the complainant wherein she has

admitted the factum of they being married and now living

together. Therefore, it is prayed that the accused-petitioner may

be enlarged on bail.

3. Learned Public Prosecutor has vehemently opposed the bail

application. However, learned counsel for the complainant does

not refute the contentions made by learned counsel for the

petitioner.

4. Having regard to the totality of the facts and circumstances

of the case, without expressing any opinion on the merits of the

case, I deem it just and proper to grant bail to the accused

petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.)

5. Accordingly, the bail application filed under Section 483 of

BNSS (Old Section 439 Cr.P.C.) is allowed and it is directed that

petitioner Devi Lal S/o Kanti Lal shall be released on bail in

connection with FIR No.76/2025 of Police Station Kotwali District

Banswara provided he executes a personal bond in a sum of

Rs.50,000/- with two sound and solvent sureties of Rs.25,000/-

each to the satisfaction of learned trial Court for his appearance

before that Court on each and every date of hearing and whenever

called upon to do so till the completion of the trial.
