Learned counsel for the petitioner, Ms. N. Savitri is present before

the court physically, similarly, learned senior counsel, Mr. T. Rajendra for

respondent Nos. 1,3,4 & 8 is also present before the court physically.

The proceeding in CRP(C.R.P. Art.227)No.28 of 2015 is connected

with the misc. cases in MC(CRP(CRP. Art.227)No.42 of 2025 and MC(CRP(CRP.

Art.227)No.43 of 2025 but the proceeding in MC(CRP(CRP. Art.227)No.43 of

2025 has been initiated keeping in view the provision of Order 22 Rule 3 of CPC

for bringing the LRs of the respondent No.4.

However, the proceeding in MC(CRP(CRP. Art. 227)No.42 of 2025

has been filed keeping in view section 5 of the Limitation Act to condone the
2

delay of 87 days in bringing the LRs of the respondent No.4 and seeking for

abatement for a period which is stated therein.

In the meanwhile, the learned senior counsel for respondent Nos.

1,3,4 & 8 seeking short accommodation on the premises that he wants to verify

the status of the LRs of the deceased respondent no.4. Therefore, keeping in

view the submission made by the said senior counsel, it is deemed appropriate

to verify the status of the LRs of the respondent No.4 for consideration of the

MC(CRP(CRP. Art.227)No.43 of 2025 and inclusive of the delay proceeding in

MC(CRP(CRP. Art.227)No.42 of 2025.

Consequently, list the matters 24.07.2025.
