The present bail applications have been preferred by the
petitioners under Section 483 of BNSS (Old Section 439 Cr.P.C.) in
connection with FIR No.68/2025 registered at Police Station
Raisinghnagar, District Sriganganagar for the offences punishable

under Sections 8/18, 21 & 25 of NDPS Act and under Section 3/25
of Arms Act.
2. Learned counsel for the petitioners submits that the
petitioners have falsely been implicated in this case. It is further
submitted that recovered contraband is below commercial quantity
and co-accused Rajkumar @ Raju has already been enlarged on
bail by the coordinate Bench of this Court vide order dated
24.03.2025 and case of present petitioner is not distinguishable.
Further, counsel submits that charge sheet has already been filed
and the accused-petitioners are in judicial custody since long.
Therefore, it is prayed that the accused-petitioners may be
enlarged on bail.
3. Learned Additional Advocate General has vehemently
opposed the bail application and submitted that accused-
petitioners are habitual offenders.
4. Having regard to the totality of the facts and circumstances
of the case, without expressing any opinion on the merits of the
case, I deem it just and proper to grant bail to the accused
petitioners under Section 483 of BNSS (Old Section 439 Cr.P.C.)
5. Accordingly, the bail applications filed under Section 483 of
BNSS (Old Section 439 Cr.P.C.) is allowed and it is directed that
petitioners (1) Simran Rathi W/o Shri Ashish Rathi & (2) Ramesh
Kumar @ Dholu S/o Shri Bhoop Ram shall be released on bail in
connection with FIR No.68/2025 registered at Police Station
Raisinghnagar, District Sriganganagar provided each of them
executes a personal bond in a sum of Rs.1,00,000/- with two
sound and solvent sureties of Rs.50,000/- each to the satisfaction
of learned trial Court for their appearance before that Court on

each and every date of hearing and whenever called upon to do so
till the completion of the trial. The petitioners are further directed
not to take undue advantage of liberty or misuse liberty.
