01. 1. This matter is taken up through Hybrid
Arrangement (Virtual/Physical Mode).

2. Since these four bail applications arise out of
one and same case record, the same are heard
together and disposed of by this common order with
the consent of the learned counsel for the parties.

3. These are the bail applications U/S.483 of
BNSS by the petitioners for grant of bail in connection
with EOW Bhubaneswar P.S. Case No.05 of 2025
corresponding to CT Case No.05 of 2025 pending in
the file of learned Presiding Officer, Designated Court

under OPID Act, Cuttack, for commission of offences
punishable U/Ss.409/420/467/468/471/120B of IPC
r/w. Section 66D of IT Act, on the main allegation of
assisting 92 numbers of ineligible persons to avail
loan by producing fake documents and causing loss to
the bank to the tune of Rs.4,77,96,009/-.

4. Heard, Mr. Saurav Tibrewal, learned counsel
for the petitioners in BLAPL Nos. 5488 & 5491 of
2025; Mr. S.K. Baral, learned counsel for the
petitioners in BLAPL Nos. 5510 & 5511 of 2025 and
Mr. A. Pradhan, learned Addl. Public Prosecutor in the
matter and perused the record.

5. After having considered the rival submissions
upon perusal of record, there appears allegation
against the petitioners for assisting the co-accused
ineligible persons to avail loan by producing fake and
forged documents. It is, however, submitted in
vehemence by the learned counsels for the
petitioners that the role as alleged against the
petitioners is very insignificant and only some
thousands of rupees have been credited to the
accounts of the petitioners, if the prosecution
allegations are taken into account, but fact remains
that the alleged action of the petitioners has caused
loss to the bank to the tune of Rs.4.77Crores. Now
the investigation is going on and release of the
petitioners would impede the investigation.

6. In view of the above facts and after having
considered the rival submissions and on going
through the materials placed on record, this Court is
not inclined to grant bail to any of the petitioners.

Hence, the four bail applications of each of
the petitioners namely Debasis @ Debasish Behera
(BLAPL No. 5488 of 2025), Niranjan Behera (BLAPL
No. 5491 of 2025), M. Dibyashree Jyotiranjan (BLAPL
No. 5510 of 2025) and Smrutiranjan Sethy (BLAPL
No. 5511 of 2025) stand rejected.

7. Accordingly, BLAPL Nos. 5488, 5491, 5510 &
5511 of 2025 stand disposed of.

8. Issue urgent certified copy of the order as
per Rules.
