1. The respondents, despite directions passed by this Court from time to
time, are not releasing the legitimate wages in favour of petitioners.
2. This Court on 04.03.2025 after taking into account the conduct of
respondents as they had not implemented the orders of this Court,
directed the Chief Engineer, Jal Shakti Department, Kashmir, Srinagar,
who was present in the Court, to explain as to why he be not punished
for not complying with the judgement of this Court.
3. This Court again on 18.04.2025 directed the Commissioner, Srinagar
Municipal Corporation as well as the Chief Engineer, Jal Shakti
Department, Kashmir, Srinagar to sit together and sort out the matter
and file compliance report on the next date of hearing and the matter
was posted on 13.05.2025.
4. On 13.05.2025, Mr. Bikramdeep Singh, Dy. AG and Mr. Jahingeer
Ahmad Dar, GA, learned counsels for the respondents, submitted that
both the departments had taken up the matter and made a proposal for
release of the amount due to petitioners with the Finance Department
and prayed for further time to do the needful. This Court, considering
the said submission of counsels for respondents, adjourned the matter
and posted it for today.
5. Today when the matter has come up for consideration, Mr. Bikramdeep
Singh, Dy. AG and Mr. Jahingeer Ahmad Dar, GA, learned counsels
for the respondents are again making same submissions as they have
been making from day one. They are unable to explain as to why the
respondents are not implementing the judgement/orders of this Court.
Therefore, this Court is left with no option but to direct the personal
appearance of Commissioner, Srinagar Municipal Corporation, and
Chief Engineer, Jal Shakti Department, Kashmir, Srinagar by
tomorrow.
6. Let Commissioner, Srinagar Municipal Corporation, and Chief
Engineer, Jal Shakti Department, Kashmir, Srinagar, shall remain
present in person before this Court tomorrow, i.e. 01.07.2025 at 10.30
AM.
7. List tomorrow, i.e. 01.07.2025.
