                          This Criminal Petition, under Sections 480 and 483 of

                  BNSS, has been filed by the petitioner herein, seeking regular

                  bail, in Crime No.7 of 2025 of Gudur Rural Police Station,

                  Tirupath'l District, registered for the offences punishable under

                  Sections 309(4) BNS, 10 read with 9(h) of the POCSO Act,

                  2012-



                  2.      Case of the prosecution, in brief, is that the victim girl,

                  aged    about       17 years,          was studying   B.Tech   lSt year;   on

                  16.01.2025 while the victim girl was returning after attending

                  calls of nature from nearby thorny bushes, the accused went

                  there, caught hold dress collar of victim girl and touched her

         breast and took her three gold rings forcibly by pointing knife

         and behaved I-ndeCently uttering words that [lnuvvu chala muddu

     vastunnavu" and tried to snatch        her chaI'n; the Victim girl

     escaped from the hands of the accused and informed the same

     to her grandfather, who, in turn, gave report to the police.


     3.        Heard. Perused the record.


     4.        Learned counsel for the petitioner submits that the gold

     ornaments which have been taken at the knife poI'nt from the

     victim have been returned to the famI'Iy of the vI-CtI'm.   He further

    submits that the petitioner was arrested on 19.02.2025 and

    since then he has been languishing in Jail.      Moreover, wI-fe Of

    the petitioner is at the advance stage of pregnancy, carrying 9th

    month and presence of the petitioner is necessary to take care

    of his wI'fe.



    5.        On the other hand, learned AssI-Slant Public Prosecutor

    submits that major portion Of the I-nVeStjgatiOn in the Present

    crl'me has been completed and the statement under section 164

    Cr.P.C., of the victim has not yet been recorded.

7. Accordingly, the Criminal Petition is allowed. The

petitioner herein shall be released on bail on his executing a

personal bond for a sum of Rs.25,000/- (Rupees Twenty Five

Thousand only) with two sureties of the like sum each to the

satisfaction of the learned Additional Judicial Magistrate of First

class, Gudur. Petitioner shall appear before the Station House

Officer concerned once in a week i.e. on every Sunday, between

10.00 AM and 5.00 PM, till filing of the charge sheet.
