2. Mr. Akshay Latwal, learned AGA, for the State of
Uttarakhand/1.

4. In the present 528 Application filed under Bhartiya
Nagarik Suraksha Sanhita, 2023, the Applicant has put a
challenge to the entire proceedings of S.S.T. No.120 of 2024,
“State Vs. Shubham“, under Sections 323, 376 (3), 376(2)(n)
506 of IPC and under Section 3(a)/4(2), 5 (1)/6 of POCSO
Act, pending in the court of learned FTC/Additional Sessions
Judge (POCSO) Roorkee, District Haridwar.

5. Considering the submissions advanced by the learned
counsel on behalf of the Applicant, an interference is being
called for in the matter.

6. Issue notice to the Respondent No.2. Steps to be taken
within a week.

7. Counter affidavit to be filed within a period of three
weeks.

8. Till the next date of listing, the entire proceedings of
S.S.T. No.120 of 2024, “State Vs. Shubham“, under Sections
323, 376 (3), 376(2) (n), 506 of IPC and under Section
3(a)/4(2), 5 (1)/6 of POCSO Act, pending in the court of
learned FTC/Additional Sessions Judge (POCSO) Roorkee,
District Haridwar, shall remain stayed.

9. List this matter on 12th August, 2025.

10. Stay application (IA No.1 of 2025) stands disposed of
accordingly.
