1. These bail applications have been filed under Section 483

B.N.S.S. (previously ‘439 Cr.P.C.’) on behalf of the petitioners, who

are in custody in connection with F.I.R. No.60/2025 dated

28.02.2025, registered at Police Station Nimbahera Sadar, District

Chittorgarh, for the offences under Sections 111(1), 112, 126(2),

189(2), 190, 191(2), 324(4), 324(5), 351(3), 352 and 333 of BNS

and Section 3 of Prevention of Damage to Public Property Act,

1984.

2. Learned counsel for the petitioners submits that the

petitioners have been falsely implicated in this case as the

allegations levelled against the petitioners along with the other co-

accused persons is that they while acting in an organized manner,

threatened and intimidated the employees working at a toll plaza

and attacked them with sticks, sword and iron rods and also,

vandalized the electronic devices installed at the toll plaza. He also

submits that the petitioners viz. Sanjay, Dhruv and Pawan are in

custody since 02.03.2025, 10.04.2025 and 11.03.2025

respectively. He further submits that charge-sheet has already

been filed in the present case and no recovery is pending against

the petitioners and thus, the they may be granted benefit of bail.

3. Per contra, learned Public Prosecutor opposes the bail

application, however, is not in a position to refute the fact that

charge-sheet has been filed against the petitioners and the fact

that no recovery is due against them.

4. Having considered the submissions advanced by the learned

counsel for the parties and having regard to the entirety of facts

and circumstances of the case as available on record; and looking

to the fact that charge-sheet has been filed against the petitioners

and the fact that no recovery is due against them; and more

particularly looking to the fact that the trial will take a long time to

conclude and without expressing any opinion on the

merits/demerits of the case, this Court deems it fit to enlarge the

petitioners on bail.

8. Consequently, these bail applications are allowed. It is

ordered that the accused petitioners viz. (i) Sanjay @ Sanju

Baba S/o Gopal, (ii) Dhruv Alias Sonu Alias Lilu S/o Mukesh

@ Maghraj and (iii) Pawan @ Paru S/o Bharat Bhambhi

arrested in connection with F.I.R. No.60/2025 dated 28.02.2025,

registered at Police Station Nimbahera Sadar, District Chittorgarh,

shall be released on bail; provided each of them furnishes a

personal bond in the sum of Rs.50,000/- and two sureties of

Rs.25,000/- each to the satisfaction of the learned trial Court, with

a stipulation to appear before that Court on all dates of hearing

and as and when called upon to do so.
