   02.       1.      This   matter   is   taken   up   through   Hybrid

Arrangement (Virtual/Physical Mode).

2. This is a bail application U/S.439 of the CrPC by
the petitioner for grant of bail in connection with
Gangapur PS Case No. 534 of 2021 corresponding to ST
Case No.31 of 2022 pending in the Court of learned
Addl. Sessions Judge, Aska for commission of offence
punishable U/Ss. 498(A)/341/304(B)/302/34 of IPC r/w
Sec. 4 of DP Act, on the allegation of committing
murder and dowry death of his wife by subjecting her
to torture and cruelty for demand of dowry prior to her
death along with co-accused persons.

3. Heard, Mr. Dipti Ranjan Mohapatra, learned
counsel for the petitioner and Mr. P. Satpathy, learned
Additional Public Prosecutor in the matter and perused
the record including the PM report of the deceased as
well as evidence of witnesses as produced.

4. After having considered the rival submissions
and on going through the materials placed on record
including the PM report and taking into account the
evidence of witness already examined, more
particularly the evidence of PW1 to PW3, this Court is
not inclined to grant bail to the Petitioner.

Hence, the bail application of the petitioner
stands rejected. However, taking into custody period of
the petitioner, the earned trial Court is once again
requested to complete the trial as soon as possible by
taking concrete and sincere steps.

5. Accordingly, the BLAPL stands disposed of.

6. Issue urgent certified copy of the order as per
Rules. A copy of this order be immediately transmitted
to the concerned Court.
