2. Mr. A.G.Momin, learned counsel for the petitioner submits that in
view of the averments made in the affidavit of the State respondents that the
pension and the terminal benefits of the petitioner will be released at the
earliest, nothing remains for consideration in the matter and prays that the
matter be closed.
3. Mr. P.T.Sangma, learned counsel for the respondent No. 8 however,
has vehemently objected to the closure of the case, on the point that there
are proceedings before the District Council Court with regard to payment of
maintenance to the respondent No. 8.
4. This Court has perused the materials as also the affidavit filed by the
State respondents, wherein it is stated that the retirement benefits of the
petitioner will be released at the earliest. In consideration thereof, the writ
petition is closed.
5. With regard to the submissions made by Mr. P.T.Sangma, learned
counsel for the respondent No. 8, it appears that the same is misconceived
as the proceedings before the District Council Court have no connection or
link with the pension and other terminal benefits which are due to the
petitioner from the State respondents.

6. Accordingly, matter stands closed and disposed of. It is expected that
the said pension matter of the petitioner be settled at the earliest, preferably
within a period of 2(two) months, from the date of this order.
