Mr. Gaurav Singh, learned counsel for the
applicant.

2. Mr. Vikas Uniyal and Mr. Prabhat Kandpal,
learned Brief Holders for the State.

3. Present petition under Section 528 of the
B.N.S.S. has been filed by the applicant to quash
the impugned charge sheet, the
summoning/cognizance order dated 01.05.2025,
passed by the learned Judicial Magistrate, 2nd,
Roorkee, District Haridwar in Criminal Case No.
187 of 2025, State Vs. Salman and Others
, under
Sections 323, 498-A, 504 & 506 of the Indian
Penal Code, 1860, as well as Sections 3/4 of the
Dowry Prohibition Act, 1961, and Sections 3/4 of
the Muslim Women (Protection of Rights on
Marriage) Act, 2019 as well as the entire criminal
proceedings of the aforesaid criminal case.

2. Learned counsel for the applicant would
submit that the dispute arises out of a matrimonial
discord between the applicant and respondent
no.2, who are husband and wife. The marriage
was solemnized on 24.02.2019 as per Muslim rites
and customs and one son was born out of the said
wedlock. Due to certain matrimonial differences,
respondent no.2 left the matrimonial home and is
presently residing at her parental house.
Subsequently, she lodged an FIR against the
applicant, which giving rise to the present criminal
proceedings.

3. Learned counsel for the applicant would
further submit that there are chances of an
amicable settlement between the parties.
Accordingly, he prays that the matter be referred
to the Mediation Centre for conciliation, and in the
meantime, the further proceedings of the criminal
case may be stayed.

4. Issue notice to respondent no.2.

5. Steps to be taken within one week.

6. Considering the submissions made by
learned counsel for the applicant, the matter is
referred to the ADR Centre of this Court for
conciliation. The applicant and respondent no.2
are directed to appear in person before the
concerned Mediator on 22.07.2025 at 10:30 A.M.
The concerned Mediator shall submit report
before the next date of listing about the
conciliation proceedings between the applicant
and respondent no.2

8. List the matter on 31.07.2025 along with the
report of the Mediator.

9. Till the next date of listing, further
proceedings in Criminal Case No. 187 of 2025,
State Vs. Salman and Others
, pending before the
learned Judicial Magistrate, 2nd, Roorkee, District
Haridwar, shall remain stayed qua the applicant.
