05. 1. Heard Mr. P.C. Sejpada, learned counsel for Appellant, Mr. R.
Pradhan, learned Additional Public Prosecutor for State-
Respondent No.1 and Mr. S.C. Mishra, learned counsel for the
informant/victim.
2. The Appellant, who has been convicted by learned Addl.
Sessions Judge-cum-Special Court under the POCSO Act,
Phulbani in C.T. Case No.2 of 2018 for commission of offence
under Section 6 of the POCSO Act and other related offences
under the IPC and sentenced to undergo R.I. for 10 years along
with fine, has prayed to release him on bail pending appeal.
3. It is submitted that the Appellant is inside custody since
15.1.2018.
4. Upon hearing Mr. R. Prahdan, learned Additional Public
Prosecutor for the State-Respondent as well as Mr. S.C. Mishra,

learned counsel for the informant/victim and going through the
evidences of all such witnesses including P.W.6 as well as the
period of custody of the Appellant, it is directed to release the
present Appellant, namely, Sidhanta Dalabehera on bail pending
appeal in connection with the aforesaid case on such terms and
conditions as the learned Addl. Sessions Judge-cum-Special
Court under the POCSO Act, Phulbani may deem just and proper.
