judgment of this Court delivered in Central Bureau of
Investigation vs. Surendra Patwa & Ors.1”

petitioner that the CBI, despite being a necessary party,

was not impleaded before the High Court. Hence, they would
fall under category 5. The counsel for the respondents
submitted that they would fall under category 2, category 3A
and category 4A.

2) Upon submissions being made, it is not in dispute that
the present matter is covered by categories 2, 3A, 4A and 5
as mentioned in para 13 of the judgment of this Court in
Central Bureau of Investigation v. Surendra Patwa & Ors.
(supra).

3) The Special Leave Petition is, accordingly, disposed
of in the aforesaid terms.

4) Pending application(s), if any, shall also stand
disposed of.
