ORDER:
This Criminal Petition, under Sections 480.and 483 of the Bharatiya
Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4,
seeking bail, in Crime No.219/2023 of Kasimkota Police Station, Anakapalle
District.

2. A case has been registered against the Petitioner and Others for the
offences under sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs
and psychotrop-lc Substances Act, 1985.
3. Case of the prosecution, iS that, On 12.7.2023 at about 5.00 pm, on
receipt of credible information regarding illegal possession and
transportation of ganja, the s.I of police, along with staff and mediators
reach.ed T.Point junction, Bayyavaram Village and found two Persons in
suspicious circumstances. on seeing the police, said two persons {r-led to
escape. Then police apprehended them. On interrogation, they disclosed
their identity particulars as Al and A3 and the police, On Ver|lfiCatiOn found
22 kgs of ganja from their possession. They confessed the involvement Of
petitioner/A4 in the commission i.e. transportation Of ganja. Police seized
the contraband, arrested the accused and got them remanded to judicial
custody. police arrested the petitioner on 24.4.2025.
4. Heard. Perused the record.
5. Learned Assistant Public Prosecutor submits that the Court may pass
appropriate orders.
6. A perusal of the material available On record goes tO Show that the
petitioner was arrested and remanded to judicial custody on 24.4.2025.
police, on receipt of credible information, seized 22 kgs of ganja from Al
and A3. Pursuant to the confessional Statement Of CO-accused, nothing has
been seized from the possession of the petitioner to connect him with the

crime. Basing on the confessional statement of co-accused, the petitioner
has. been a’rrested and remanded to judicial custody.
7. In view of the aforesaid facts and circumstances of the case, this
Court is inclined to grant bail to the petitioner/A4 herein, on the following
conditions.
(i) The petitioner/A4 herein shall be released on his- executing a
personal bond for Rs.10,00.0/-(Rupees ten thousand only) with two
sureties for a like sum each to the satisfaction of the learned I
Additional District and Sessions Judge-cum-Special Judge for Trial ofOffences Under NDPS Act, Visakhapatnam;
(ii) On release, the petitioner shall appear before the Station House
Officer concerned once in a week i.e. on every Sunday between 10.00
a.m. and 05.00 p.m., till filing of charge sheet.
8. Accordingly, the Criminal Petition is allowed.
