1. The present appeal was filed with the delay condonation application, which was allowed vide order dated 14.08.2024. The lower court record has already been summoned.
2. We therefore, proceed to hear Shri Jai Narain, learned AGA-Ist for the purpose of considering Criminal Misc. Application (Leave to Appeal).
3. Heard Shri Jai Narain, learned AGA-Ist appearing for the appellant-State of UP and perused the record.
4. Present Government Appeal has been preferred against the judgement and order dated 15.01.2018 passed by the Additional Sessions Judge / F.T.C., Court No. 7, Mirzapur, in Sessions Trial No.78 of 2016 (State Vs. Kanhaiya Sonkar), under Sections 376, 354, 354-A IPC, Police Station Kotwali Shahar, District Mirzapur.
