1. Heard Sri Rakesh Kumar Rathore, learned counsel for the petitioner and learned Standing Counsel for the respondent-State.

2. Vide order dated 13.05.2010 passed by the respondent no.3-District Magistrate, Mainpuri, the fire arm license of the petitioner was cancelled on the ground that Case Crime No.1/05, under Section 323, 325, 308 and 504 IPC is pending against the petitioner.

3. It is argued by counsel for the petitioner that the proceedings of the aforesaid case has already been stayed by this Court. Aggrieved against the aforesaid statutory appeal as provided under Section 18 of the Indian Arms Act, 1959 was filed by the petitioner before the Commissioner, Agra Division, Agra/respondent no.2, which was numbered as Case No.22/2009-10, which was rejected on the same ground.
