The petitioner was convicted and sentenced to rigorous

Reason: (Special POCSO) Case No.51/2017 for the offences punishable
under Sections 376DA, 328 & 506 of the Indian Penal Code and
under Sections 5(g) & 6 of the POCSO Act. His interim

application for enlargement on bail during pendency of appeal
was dismissed by the High Court under the order impugned.
Being aggrieved, he approached this Court. He has already
undergone about three years and his appeal is pending before
the High Court.
Heard learned counsel for the petitioner and the
respondent-State. As per office report dated 11.07.2025,
despite service of notice, the respondent no.2 has not entered
appearance.
Considering the period of incarceration of the petitioner
and the other relevant factors, we are of the opinion that a
case of bail is made out for the petitioner.
Accordingly, the petitioner is directed to be released on
bail forthwith on the usual terms and conditions to be decided
by the concerned Court.
The present petition shall stand disposed of in the above
terms along with all pending application(s).
