1. Heard learned Counsel for the appellant, learned A.G.A. for the State of U.P. and perused the record.

2. The instant Criminal Appeal under Section 374 (2), Cr.P.C. has been filed by the appellants namely Ram Prakash, Rajendra Kumar and Ram Kishore, all sons of Shitla Prasad Lohar, challenging the judgment and order 30.03.2009 passed by Fast Track Court No.1/Additional District and Sessions Judge, Raibareli in Session Trial No.202/1999, arising out of Crime No.88/1993, P.S.- Jayas, District- Raibareli under Sections 198(A) of U.P.Z.A. & L.R. Act,1950 (in short ‘Act of 1950’) and Section 3(1)(4) SC/ST Act 1989, convicting and sentencing the appellants under Section 198(A) of the Act of 1950 to undergo three months simple imprisonment and fine of Rs. two thousand each and under Section 3(1)(4) SC/ST Act to undergo six months and fine of rupees one thousand each, with default stipulation.
