I.A. No. 1880/2025 (Application under Order VIII Rules 1 & 10)
1. The instant application has been preferred by the plaintiff under Order
VIII Rules 1 and 10 of the Code of Civil Procedure, 1908 (“CPC”), for
pronouncement of judgment and passing of a decree against the defendants,
in the form of a permanent and mandatory injunction for restraining the
defendants, and further to award damages and actual costs of litigation in
favour of the plaintiff.
2. The present suit has been filed by the plaintiff under Section 134(1)
of the Trade Marks Act, 1999 (“the Act”), read with Sections 27 and 29 of
the Act and Section 20(c) of CPC, seeking permanent and mandatory
injunction thereby restraining passing off and infringement of plaintiff‟s
marks /trade dress, i.e., “ORS-L”/ “ORSL”/ / /
