1. The instant second bail application has been filed by the

petitioner under Section 483 BNSS who has been arrested in

connection with the FIR No.130/2024 dated 30.06.2024 registered

at the Police Station Rajtalab, District Banswara for the offences

under Sections 420, 201, 120B of IPC and Section 66-D of I.T. Act

and Sections 3, 4, 6 2 F (ii)/10 of the Rajasthan Public

Examination (Measures for Prevention of Unfair Means in

Recruitment) Act, 2022.

2. Learned Senior Counsel for the petitioner submits that the

petitioner has been falsely implicated in this case. He submits that

the first bail application preferred on behalf of petitioner was

rejected on 12.05.2025 while granting liberty to the petitioner to

file fresh bail application after filing of the charge sheet. Learned

counsel submits that now the charge sheet has been filed. While

drawing the attention of the Court, learned Senior Counsel for the

petitioner submits that role of the petitioner is similar to the role

of co-accused, namely, Naresh Dev, who has been enlarged on bail

by this Court vide order dated 12.05.2025 passed in S.B. Criminal

Misc. Bail Application No.4961/2025. He further submits that other

co-accused, namely, Savita Dodiyar, Sheela, Smt. Shilpa, Smt.

Nirma, Sangeeta and Abhimanyu Singh have also been enlarged

on bail by a Coordinate Bench of this Court vide order dated

27.09.2024 passed in S.B. Criminal Misc. Bail Applications

No.9959/2024, 9357/2024, 9358/2024 and 9433/2024. He also

submits that co-accused, namely, Sakan Singh has also been

enlarged on bail by the Additional Sessions Judge, Banswara vide

order dated 05.10.2024. He thus submits that the case of the

present petitioner is not distinguishable with the case of

Abhimanyu Singh, Naresh Dev and Sakan Singh and, therefore,

the petitioner may also be enlarged on bail.

3. Per contra, learned Public Prosecutor opposes the bail

application, however, is not in a position to refute that the case of

the petitioner is also similar to the case of co-accused, namely,

Abhimanyu Singh, Naresh Dev and Sakan, who have been

enlarged on bail vide orders dated 12.05.2025, 27.09.2024 and

05.10.2024 respectively. Learned Public Prosecutor is not refuting

the fact that charge sheet has been filed.

4. Having considered the submissions advanced at Bar by

learned counsel for the parties and having regard to the entirety

of facts and circumstances of the case as available on record; and

looking to the fact that trial may take a long time to conclude and,

without expressing any opinion on the merits/demerits of the

case, this Court deems it fit to enlarge the petitioner on bail.

5. Consequently, the instant second bail application is allowed.

It is ordered that the accused petitioner Kanwararam S/o

Devaram Jat arrested in connection with FIR No.130/2024 dated

30.06.2024 registered at the Police Station Rajtalab, District

Banswara shall be released on bail; provided he furnishes a

personal bond in the sum of Rs.50,000/- and two sureties of

Rs.25,000/- each to the satisfaction of the learned trial Court, with

a stipulation to appear before that Court on all dates of hearing

and as and when called upon to do so.
