1. This is an appeal under section 415 (3) BNSS, 2023 preferred by the
appellant against the impugned judgment dated 21.09.2024 and order on
sentence dated 11.12.2024 passed by Court of Ld. Judicial Magistrate First
Class-(NI Act-01), South East District in CT No. 1281/2019 titled Rajesh
Kumar Saini Vs. Mukesh Saini, whereby the appellant/ convict Mukesh
Saini was convicted of the offence punishable under Section 138 of
Negotiable Instruments Act and was sentenced to simple imprisonment for
03 months and was directed to pay a compensation of Rs. 2,60,000/- with
simple interest thereon @ 9% per annum from the date of filing of
complaint till making actual payment, within 30 days to the respondent. In
default, appellant/ convict Mukesh Saini is to undergo simple
imprisonment for 02 months. For the sake of convenience, the appellant/
convict herein shall be referred to as ‘accused’ and the respondent herein
shall be referred to as ‘complainant’.
