In the instant bunch of petitions, vide order dated 19.05.2025,
Court has granted interim protection to the petitioner(s) subject to
joining investigation. Further, on 08.05.2025 in S.B. Criminal
Miscellaneous (Petition) No. 2037/2025 similar interim protection was
granted by the Court in favor of the petitioner(s).
Considering the factual matrix of the matter and taking note of
the fact that matter pertains to a financial transaction qua real estate,
directions were passed to conduct inquiry in the instant matter in
accordance with law including the provisions of Income Tax Act as
enunciated in The Correspondence RBANMS Education Institution
Vs. B. Gunashekar & Anr., Civil Appeal No.5200/2025.
When the matter is called, learned counsel for the State has
furnished a factual report and has submitted that investigation is
ongoing in the instant matter and genuineness of transaction is under
evaluation.
Considering the facts and circumstances of the case, this Court
deems it apposite to dispose of the present petitions with direction that
investigation be conducted in the instant matter by the concerned
Authorities. Further, no coercive action be taken qua both the parties. It
is made clear that the said interim protection is operational till filing of
conclusion by the concerned authority.
Accordingly, the present petitions are disposed of. Pending
applications, if any, shall stand disposed.
